Legal Restrictions on the Import and Export of Hazardous Materials and Waste

Egypt’s Waste Management Regulation Law establishes a number of restrictions and requirements governing the export, import, transportation and handling of hazardous materials and waste.

Article 59 prohibits the export of hazardous materials or waste outside the Arab Republic of Egypt unless prior approval is obtained from the Waste Management Regulatory Authority. The law also provides for a decision by the competent minister, in agreement with the Minister of Trade and Industry, to determine the requirements and procedures for obtaining such approval.

Article 60 prohibits establishing or operating facilities for the trading or integrated management of hazardous materials or waste without a license from the competent administrative authority and prior approval from the Authority.

The law also requires hazardous waste to be disposed of according to the conditions and standards set out in the executive regulations. Relevant authorities are responsible for determining disposal sites after obtaining the required approvals and consulting the concerned ministries and authorities.

Facilities whose activities generate hazardous waste are required to classify, collect and package such waste, as well as provide the necessary equipment and supplies for separation, collection, transportation and storage within the facility.

Article 62 prohibits the import of hazardous waste or allowing it to enter or transit through Egyptian territory.

The law also prohibits ships carrying hazardous materials or waste from passing through Egypt’s territorial waters or exclusive economic zone unless they obtain the required authorization from the Ministry of Transport or the Suez Canal Authority, as applicable, and receive approval from the Waste Management Regulatory Authority.
